Are Property Owners Responsible for Maintaining & Repairing Sidewalk in NYC?

According to section7-210 of the New York City administration, the property owners of both residential as well as commercial property are primarily responsible for repairing and maintaining their sidewalk in the front and side. The owners should keep the sidewalk in a safe condition so that pedestrians can use it without any fear.

The sidewalk in your area must be clear of snow, ice accumulation, plant growth, dirt, or any other debris. The primary aim behind this law is to exempt the city from any kind of liability in case of injuries.
If there are any injuries that occur due to sidewalk damage, then the owner will be responsible. In order to get the sidewalk back in its original shape and to avoid further penalties, the owner must hire a professional sidewalk repair NYC contractor

NYC DOT Inspections

The department of Transportation (DOT) carries out inspections throughout the city so that they can raise a red flag related to a damaged sidewalk. These inspections are carried out to ensure the safety of users. If there is any damaged sidewalk, then a violation is issued.

There are many reasons for which a violation can be issued, such as tripping hazard, cracked or loose portions of the sidewalk, improper slope, faults in patchwork, etc. If a utility company or a contractor damages the sidewalk, the owner still remains responsible and has to be sure that repair work is done in the damaged area.

It is better to have a video/photo document when doing repair work. Later on, it helps coordinate among departments when it is time to get the notice dismissed. The violation will be active with NYC DOT until the repairs are done.

There are no fines when it comes to sidewalk violation; however, after 75 days, the DOT will itself step in and do the construction/repair on your behalf. If this happens, the DOT will get a bill issued in your name from the finance department.

Facts and figures related to sidewalk violations

The city doesn’t impose any restriction on one, two, or three-family properties with a damaged sidewalk caused by a city tree. The DOT and the park department will inspect the area for any dangerous sidewalk condition and will perform the repair work by themselves. In case of tree-related damage only, the homeowner will not do any kind of repair.

The DOT reviews the notices that were issued by tree damage and cancels them if they meet the criteria. If the homeowner of the concerned property is selling or refinancing their home, the evaluation will be done again. The Parks department initiated the ‘Trees and sidewalk’ program to give benefit to homeowners by repairing damaged sidewalks with trees.

To what extent homeowner is responsible?

The NYC parks, trees, and sidewalks programs offer repair options to house owners with tree damage, or you can hire a sidewalk repair NYC contractor. When it comes to residential homes, the owners will not pay for the repair work; instead, the department will make sure to get it done. The program, however, has limited funds, and the city agency decides the priority.

There are numerous codes, rules, and regulations to be followed in NYC, and the property owners should be aware of them. The rules and regulations are in place for the safety and security of the public. If you are confused about any codes, sidewalk-related problems, or your building, make sure to seek advice from an expert, and we are always here to help.
